Malindi MP Aisha Jumwa and her bodyguard, Okuto Otieno, have been granted Sh1 million bond and a surety of a similar amount with the alternative of Sh500,000 bail.
They appeared before Mombasa Senior Magistrate Vincent Adet. The magistrate said the police have the liberty to charge the two if thet have evidence ganist them.
He also asked them to present themselves to the DCIO in Malindi on October 22 to assist with investigations and any further summons will be issued from there.
The prosecution sought to have them detained for 21 days pending investigations but the magistrate said that “It’s illegal for the police to have someone they don’t have evidence against to be held without a charge. Police must only arrest when they have evidence against suspects. The Constitution disallows this.”
The two were arrested on Tuesday after a man had been shot dead in an ODM meeting. They spent the nigh in custody and were arraigned in court today
